FAQ | Frequently Asked Questions

I have employees who are self-employed (PJ). Do they need to be registered with Pontotel?

Employees hired as legal entities (PJ) are not required to clock in and out, since Decree-Law No. 5,452/1943 of the CLT (Consolidation of Labor Laws) only governs formal employment contracts with an employment relationship. As service providers, they are not subject to the mandatory timekeeping requirements stipulated in Brazilian labor law and, consequently, there is no need to register them on the platform.

However, it's worth emphasizing that Pontotel is not just a time tracking system. Our platform allows you to centralize and monitor the work hours of everyone in the company, including freelancers, offering reports and controls that bring more transparency, organization, and efficiency. Therefore, even without legal obligation, many companies choose to register freelancers to keep attendance management aligned and integrated with the entire team.

How do I compensate my employees for hours off so they can have time off at the end of the year?

If your company already uses a time bank system, it's important to first check how the time bank rule is configured. This is because each rule defines which time entries are automatically converted to the time bank.

For example: if overtime hours are credited, the employee can accumulate a positive balance by working slightly beyond the expected hours on some days. Similarly, if absences are converted to a time bank, the system will deduct from this positive balance when the employee takes time off at the end of the year.

For this to work correctly, please confirm in your time bank rules which time entries are being converted. If you have any questions about how to check this setting, please contact our Support team , who will be able to guide you.

Another point to consider is the time bank cycle. If it expires before the end of the year, it will be necessary to record a write-off to start a new cycle. However, if the goal is to maintain a positive balance for compensation during the holidays, instead of paying the accumulated balance on the payroll, it is possible to record this amount as a credit in the new cycle, ensuring that the days off at the end of the year are properly compensated.

Are managers in positions of trust required to clock in and out?

Managers who hold positions of trust are not legally required to clock in and out. Article 62, item II of the Brazilian Labor Code (CLT) establishes that employees in positions of trust are exempt from timekeeping, precisely because of the distinct nature of their role.

However, we emphasize that Pontotel is not limited to being just a time and attendance system. Our platform also supports work schedule management and information transparency. Therefore, many companies choose to register managers and trusted employees, even without legal obligation, to centralize data, track attendance, and maintain consistent reports for the entire team.

Does the system meet legal requirements, such as Ordinance 671?

Yes, the Pontotel system fully complies with the requirements of Ordinance 671 of the Ministry of Labor and Employment. This ordinance regulates the use of electronic time and attendance systems (REP-P) and defines rules for the collection, storage, and processing of time records.

The platform was developed precisely to guarantee legal compliance, legal security, and transparency in work schedules. In addition to complying with Ordinance 671, the system maintains all records in an inviolable and auditable manner, offering complete reports compatible with inspections. This means that by using Pontotel, your company is in line with current legislation and also gains in practicality and reliability in time and attendance control.

Is it possible to generate reports for labor audits and inspections?

Yes, it is possible to generate specific reports and files for labor audits and inspections directly through Pontotel. In addition to traditional reports on time tracking, time entries, time banks, and timecard summaries, the platform also allows exporting tax files required by law, such as:

  • E05 – AFD Archive
  • E06 – AFDT Archive
  • E07 – ACJEF Archive

These files follow the standards established by Brazilian labor law and Ordinance 671, ensuring that your company is compliant in any potential audits. This provides legal security and practicality in presenting information clearly, reliably, and within official parameters.
